Welcome to Hot City Smoke Shop HTX. These Terms of Service (“Terms”) govern your access to and use of our website at hotcityinc.com and any products, services, and content offered through it (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

1) Eligibility & Age Verification

You must be 21+ to access or use this site or purchase age-restricted products. By using the Services, you represent that you are of legal age in your jurisdiction. We may use third-party age-verification and require government-issued ID at pickup or delivery.

2) Products & Legal Use

We offer tobacco, nicotine, hemp-derived products (including THC-A where permitted by law), accessories, and related goods. You are responsible for ensuring that purchase, possession, and use comply with all applicable federal, state, and local laws in your location. Products are for legal use only and not for resale without our written permission.

Hemp/THC Notice: Where applicable, hemp products are intended to contain Δ9-THC ≤ 0.3% on a dry-weight basis under U.S. federal law. Statements have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease. Keep out of reach of children and pets. Use at your own risk and follow all manufacturer instructions, especially for batteries and chargers.

3) Orders, Processing & Fulfillment

Processing Time: Orders typically process within 1–2 business days (Mon–Fri).
Shipping Methods: We primarily ship via UPS Ground (carriers may vary). Adult signature (21+) is required for age-restricted items.
Shipping Areas: We currently ship within the United States where permitted by law. We do not ship internationally and do not ship to jurisdictions that restrict the products you ordered. Certain products may be pickup-only due to carrier or legal restrictions.
In-Store Pickup: Available at 17560 Kuykendahl Rd, Spring, TX 77379 during store hours. Bring a matching government-issued ID and the payment card used.
Risk of Loss: Title and risk of loss transfer to you upon carrier acceptance.
Order Changes/Cancellations: We may cancel any order (e.g., failed age verification, suspected fraud, product limits, regulatory restrictions). If canceled, we’ll refund the original payment method.

4) Returns, Exchanges & DOA Policy

All sales are final. For safety and regulatory reasons, we do not accept returns and do not issue refunds on opened or used products, consumables, or age-restricted items.

Defective/DOA Items: If an item arrives damaged or defective, contact us at store1@hotcitysmokeshop.com within 48 hours of delivery or pickup with your order number, photos/video, and a description. After review, we may offer replacement or store credit at our discretion. Items must be in original packaging with all components.

5) Accounts & Personal Information

You may need an account or to provide personal information to purchase or contact us. You are responsible for your account credentials and for all activity on your account. We handle personal data per our Privacy Policy available at hotcityinc.com/privacy.

6) Prohibited Uses

You agree not to:

Violate any law or infringe IP or privacy rights;
Bypass or interfere with age verification or security features;
Resell products commercially without written permission;
Use bots/scrapers or disrupt site operation;
Submit false, misleading, or fraudulent information.

We may suspend or terminate access for violations.

7) Pricing, Availability & Errors

Prices, promotions, and availability may change without notice. We reserve the right to correct errors or inaccuracies and to cancel orders affected by such errors.

8) Payment Terms

We accept major credit/debit cards (Visa, Mastercard, American Express, Discover) and select digital wallets (e.g., Apple Pay, Google Pay) as available at checkout. By submitting a payment, you represent you are authorized to use the payment method and authorize us (and our payment processor) to charge it for your order, taxes, and any applicable shipping/fees. Chargebacks for valid orders may result in account suspension.

9) Intellectual Property

All site content (logos, images, text, graphics, product descriptions, and other materials) is owned by Hot City Smoke Shop HTX or its licensors and is protected by law. No license is granted except as necessary to use the Services for personal, non-commercial purposes.

10) Third-Party Links & Content

The Services may reference third-party sites, products, or services. We do not control or endorse third-party content and are not responsible for their terms, policies, or actions.

11) Health & Safety Disclaimers

Use products responsibly. Do not modify devices. Follow manufacturer guidance. Battery and charger misuse can cause injury or fire. If you are pregnant, nursing, taking medication, or have a medical condition, consult a physician before use.

12) Warranty; Disclaimers

Except as expressly stated, products and Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of Liability

To the maximum extent permitted by law, Hot City Smoke Shop HTX and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits or data, arising from or related to your use of the Services or products. Our total liability for any claim shall not exceed the amount you paid for the product(s) at issue.

14) Indemnification

You agree to indemnify, defend, and hold harmless Hot City Smoke Shop HTX from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services or products.

15) Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis in Harris County, Texas, administered by the American Arbitration Association under its applicable rules. You and Hot City Smoke Shop HTX waive the right to a jury trial and to participate in a class, collective, or representative action. Either party may seek relief in small claims court for qualifying claims. This section does not prevent either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction.

16) Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

17) Changes to the Services or Terms

We may modify the Services and these Terms at any time. Changes are effective upon posting to the website with the “Effective Date” updated. Your continued use after changes indicates acceptance.

18) Termination

We may suspend or terminate access to the Services at any time for any reason, including suspected violations of these Terms. Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, limitation of liability, arbitration).

19) Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Services.

20) Shipping Policy (Summary)

Processing: 1–2 business days.
Carrier: Primarily UPS Ground (tracking provided).
Adult Signature: Required (21+) for age-restricted items.
Limits: U.S. only where permitted by law; some products may be pickup-only.
No international shipping.

We do not currently offer subscriptions. If we add subscriptions in the future, additional terms will apply and be posted here.
